What Is The Procedure For Same Day Marriage In Court ?

Documents necessary to apply for a court marriage:

Documents mentioned below are necessary to be prepared in advance to apply for initiating the Court Marriage in Agra or any other city-

  • Application form shall be properly filled and signed by the couple applying for the court marriage.

  • Nominal fees shall paid as prescribed by the law and its receipt must to be attached to the application form

  • Documents proving the date of birth of the parties 

  • Passport-size photos of the parties to the court marriage.

  • If any of the parties applying for a court marriage is a divorcee or a widow/er, then a copy of such divorce decree or death certificate of the previous spouse respectively are required to be submitted.

  • Residential proof that at the very least one of the parties to the court marriage has been living in an area falling under the jurisdiction of the marriage officer.

  • Separate affidavits from parties to the court marriage regarding their- 

  • Date of birth of the parties

  • Present marital status, i.e. unmarried/divorced/widow(er) of the couple

  • Declaration from the couple stating that they do not fall under the degree of prohibited relationships.

Procedure for Court Marriage-

The procedure for court marriage as provided under the law has been explained as under- 

  • Notice of intended Marriage- The first step when applying for Court Marriage in Jaipur  or any other city will be to file a “notice of Intended Marriage”. As per the Second Schedule of the Special Marriage Act, 1954 a notice should be sent to the marriage officer or your area. The notice for court marriage must include the proof from the couple about their marital status, occupation, age, residential address, permanent address, etc as required by the law. This notice will be submitted to the Marriage Officer under whose jurisdiction either one of the parties to the marriage have  been residing for at least 30 days.

  • Publishing the Notice- the Marriage Officer would then enter the details of the notice in the records of the Marriage Office, these records shall be kept open to the public, as well as a copy of this notice will be published in some part of the office of the Marriage Officer from where it is visible to the general public.

  • If none of the parties reside in the area falling under the jurisdiction of the Marriage Officer, then in such a situation,  the marriage officer shall forward the notice to the respective Marriage Officer under whose jurisdiction the parties to the court marriage reside permanently.

  • Objection to the court marriage- a waiting period of 30 days will be provided under the law after the notice for the court marriage has been published in the office of the marriage officer. Therefore, any objection to the application for court marriage could be made on the basis of the grounds provided during these 30 days.

  • In case an objection is raised against the court marriage application, the registrar shall be bound to make inquiries regarding the same, these inquiries regarding the said objection must be made within a period of 30 days from the date such objection was raised.

  • The objection to the court marriage is found to be valid by the marriage officer; he can cancel the application for court marriage, hence ending the process. The parties have the right to file an appeal in the respective district court against such decision of the Marriage Officer. The appeal against such decision is required to be filed within a period of 30 days from the date of cancellation of the application.

  • After the 30 days period, as provided by the law, has ended and no objection is raised or the result of the enquiry made for the same was in the favour of the parties, then the permission of marriage will be granted and a date would be provided. 

  • On the date so assigned, parties shall be present in the Court  with three witnesses as well.

  • After solemnization of the marriage, a certificate of marriage is required to be issued by the marriage officer, it shall include the signatures of the three witnesses to the court marriage, the married couple as well as the marriage officer. The certificate issued is the conclusive evidence of the marriage.

If an appeal is filed against the decision of the marriage officer, the aforementioned period of three months shall be counted from the day the decree of the district court was passed.
