What is the success rate of SLPs in the Supreme Court?

This Is Not An Appeal, But A Petition Was Filed For An Appeal. After The SLP is Filed, The Supreme Court Will Review The Case, Grant "Leave" If It Thinks It is Appropriate, And Then The Petition Will Be Turned Into An Appeal. Next, The SLP will Become An Appeal, And The Court Will Have The Opportunity To Hear The Case And Render A Decision In Light Of It.

What is the success rate of SLPs in the Supreme Court?
Success Rate:

A Special Leave Petition (SLP) Argued By A Senior Advocate Has Approximately Twice The Likelihood Of Being Heard By The Supreme Court Than Cases Without A Senior Advocate, According To Research.

According To The Numbers Provided By The Top Court, There Were Approximately 71,000 Cases Submitted For Admission To The Supreme Court In 2014, Of Which Approximately Half (34,500) Were Slp About Civil Cases. Therefore, The Apparent Shift In Favor Of The Petitioner Is Quite Significant.

In Essence, An SLP filed Under Article 136 Of The Constitution Asks The Court To Use Its Discretionary Powers To Hear An Appeal Against Any Of The 24 High Courts In India.

On "Miscellaneous Days," Which Are Every Monday And Friday, The Supreme Court Lists These Slps For The First Time. During These Days, Advocates Have An Average Of Five Minutes To Persuade A Bench Of Two Judges That There Is A Problem With The Ruling Of The High Court They Are Appealing From And That Their Appeal Or Petition Is "Special" Enough That The Supreme Court Should Take Up Its Time To Hear It.

Since There Are Usually Only Two Possible Outcomes From An SLP hearing: Either The Matter Is Dismissed Or A Notice Is Issued, The First Hearing Is In Many Ways The Best Opportunity To Analyze The Efficacy Of Senior Advocates. Moreover, Only Counsel Represents The Petitioner In The Majority Of Slps.

The Other Party Is Notified And The Case Is Added To The Supreme Court's Backlog Of Over 60,000 Pending Cases If The Court Decides To Take Up The Matter For Additional Hearings. If A Client Or Their Advisor Is Dissatisfied With A High Court's Ruling, The SLP is Frequently Their Only Remaining Legal Avenue Of Appeal.

It Is Understandable Why Senior Advocates Are So Pricey And Why Many Clients Seem Content To Pay Those Rates Given How Much Depends On The Brief Window Of Time It Takes To Get An SLP admitted. It Is Currently Gathering Data From The Supreme Court Website On Every Case To Compile It Into A Format That Will Allow For Meaningful Analysis. Vidhi Chose 378 Civil Slps At Random From Among The 34,500 Slps In 2014 In Which The Petitioner Was The Only One Represented By Counsel. Even Though It Had Been Between Eight And Sixteen Months Between Hearings, Of These 378 Cases, Orders About The First Date Of Hearing Had Only Been Uploaded On The Website In 290 Cases.

There Is A Clear Difference In The Success Rates Of Senior Advocates And Non-Senior Advocates When Analyzing The Orders Issued In These 290 Cases. Based On Those Data, The Average Chance Of Success For A Civil SLP before The Supreme Court Is Slightly Less Than 44%.

In About 38% Of Those 290 Slps, There Was At Least One Senior Advocate Present; In Those Cases, The Court Issued Notice Almost 60% Of The Time. In The Remaining 177 Cases, Notice Was Given In Less Than 34% Of The Cases Where A Senior Advocate Did Not Appear. Years From Now, The Slps Who Make It To Trial Will Find Out What Happens To Them.

The Next Course Of Action If The Supreme Court Rejects A Special Leave Petition (SLP) Will Depend On The Circumstances Of The Case And The Available Legal Remedies. Among The Choices That Might Be Available Are:

  • Making A Petition For Review: A Review Petition Can Be Filed Within The Allotted Time Frame To Ask For A Review Of The Supreme Court's Ruling If There Are Good Reasons For It.

  • Examining The Healing Prayer: After All Other Options Have Been Exhausted, A Curative Petition May Be Filed In Some Very Rare Circumstances. As A last-resort remedy, A Curative Petition May Be Filed In Situations Where Natural Justice Principles Have Been Broken.

  • Looking For Other Legal Remedies: Depending On The Circumstances Of The Case, You Might Be Able To Look Into Other Legal Remedies Like Submitting A Writ Petition Or, If Appropriate, Going Before A Relevant Authority Or Tribunal.
